In an article published by the NJ Star Ledger a New Jersey Collection Agency broke the Fair Debt Collection Practices Act so frequently they have been sued almost twice per week by angry debtors. This is a problem for the agency but also a problem for their clients.
How much do you think any of the clients received on all those claims? How many of them were sued along with the agency?
Some of the violations included constant calling despite the debtor request for them to stop, failure to produce documentation and failure to check out the debtor’s contention that the bill was paid. Furthermore, the bill was 10 years old.
In addition to the many law suits, there were a continuous stream of complaints to the Better Business Bureau and the Department of Consumer Affairs.
When you decide to use a Debt Collection Agency, check them out. You will ask for references and the fee rate, but you should also check the suit rate and complaint rate as well. Just as much money can be collected without violating the law; perhaps even more. Don’t choose a potential headache.
